Submitting Canadian patent applications

Reporting to you at no charge

ATMAC does not charge anything for electronically forwarding to you:

  • Filing receipts,
  • Notices of allowance,
  • Maintenance fee reminders,
  • Acknowledgements of examination,
  • Office actions,
  • Election requirements,
  • Courtesy letters,
  • Assignment recordals, and
  • Most other correspondence from CIPO related to your application.

Upon receipt of correspondence related to your application or patent from CIPO, ATMAC will scan the correspondence and forward to you via e-mail.

You will only be charged if you instruct ATMAC to forward you the original paper copy and we will confirm the postage price in advance.

Submitting an already-drafted document to CIPO on your behalf

If you instruct ATMAC to submit an already-drafted document or letter to CIPO, ATMAC only charges a nominal fee. For example, if you have a prepared on your own a response to an Office action and wish to file it as economically as possible, ATMAC will only do a formalities review without addressing the substantive merits of the application.

To receive a quote for the total price to review and submit an already-drafted document to CIPO, please provide the following items:

  1. Canadian patent / application number
  2. A copy of the Office action received from CIPO (only required if ATMAC does not already have a copy)
  3. Your written response to the OA and/or any other documents you wish to have filed

For any documents that you have drafted, Microsoft® or LibreOffice® document formats are preferred in case we need to make any adjustments before submitting to CIPO; for other documents, Adobe® PDF format is preferred.

Assistance drafting response to Office action (OA) on merits

If your invention is related to the fields within our expertise, ATMAC can assist you to draft a complete response to a CIPO Office action on the merits. To receive an estimate for the total price, please provide the following items:

  1. Canadian patent application number
  2. A copy of the Office action received from CIPO (only required if ATMAC does not already have a copy)
  3. Any comments or instructions you have (optional)

Payment of annual maintenance fees

Annual maintenance fees are required for patents and patent applications in Canada starting on the second anniversary of the Canadian filing date (or the international filing date for national stage applications from a PCT application).

To pay one or more maintenance fees, ATMAC only needs you to provide the following:

  1. Canadian patent / application number
  2. How many years of maintenance fees you want to pay (minimum 1 year, but you can pay any of the years in advance in a single submission if desired to save on the ATMAC service fee)

Upon receipt of the above items, ATMAC will review the situation and estimate required costs before proceeding. ATMAC charges the same service fee regardless of how many years worth of maintenance fees are paid for a single application in the submission. To save on service fees you can pay multiple years’ maintenance fees at the same time.

Note: In the event that you are late paying a maintenance fee, there is an additional government late fee surcharge as long as you are still within 1 year of the maintenance fee due date. In the event that you fail to pay an annual maintenance fee and let one year pass from the due date without paying the maintenance fee plus the late fee, your application will be abandoned. There is no way to reinstate it if this happens. Furthermore, for applications with a filing date on or after Oct. 30, 2019, a showing of due care will be required for successful reinstatement if a maintenance fee deadline is missed by six (6) months of more.
